At SharkNinja, we exist to deliver on our mission of “positively impacting people’s lives, every day in every home.” This includes doing everything possible to protect your privacy and secure your personal information.

This Candidate Privacy Notice describes how SharkNinja Operating LLC and SharkNinja Europe Ltd (hereinafter and together “SharkNinja” or, individually and for the purpose of local recruitment, “Local SharkNinja”), as the data controller(s), handle and protect your Personal Data in connection with SharkNinja’s recruiting processes and programs. In case of a conflict between this Privacy Notice and applicable law, applicable law will govern.

“Personal Data”, “Processing”, and other terms that are capitalized in this Privacy Notice but not otherwise defined herein, shall have the same meaning as in the EU General Data Protection Regulation 2016/679 (“GDPR”).

This Privacy Notice only applies to the Personal Data of job applicants, potential candidates for employment or partnership, and those who participate in our recruiting programs and events. This Personal Data is submitted directly to SharkNinja through the online application process and follow-up communications and/or through alternative channels (e.g., via professional recruiting firms).

Personal Data we collect

The types of Personal Data that we request from you and the ways that we process it are determined by the requirements of the country in which the relevant Local SharkNinja entity which may hire you is established and where the role you apply for is located. Should you apply to more than one location, the types of Personal Data we request from you and the ways that we process it are determined by the requirements of all the countries in which the position is located.

We collect these Personal Data directly from you when you apply for a role with us:

Candidates in Illinois: your separate consent is required before any AI analysis of your video interview takes place., based on the words and content of your spoken responses. 
Candidates in Illinois: before your interview, we will explain how Notetaker works and the general types of characteristics it uses to generate notes and scores, and we will obtain your separate consent, as required under the Illinois Artificial Intelligence Video Interview Act. You may request that your interview recording be destroyed within 30 days of your request.
Legitimate interests in accurately documenting interviews; 
supporting consistent, well-informed evaluation of candidates. 
Candidates in Illinois: your consent, obtained before your interview recording is analyzed, as required under the Illinois Artificial Intelligence Video Interview Act. Candidates in China and Vietnam: see your local privacy notice.
Audio and video recordings of interview sessions; AI-generated transcripts; AI-generated interview notes and suggested scorecard entries; your name and contact details as session metadata. During your interview, content may incidentally include special category data such as information about your health, beliefs, or other protected characteristics. SharkNinja does not require or use this information to make decisions about your application and will follow its process to remove such content if shared
AI-assisted fraud detection and identity verification at application stage. SharkNinja uses an AI tool to generate fraud signals from your application data to protect the integrity of the recruitment process. Outputs are reviewed by a member of the recruitment team before any decision is made on your application Legitimate interests in maintaining the integrity of our recruitment process and protecting against fraudulent applications. Candidates in Illinois: your consent, which will be obtained before your application is processed. Candidates in China and Vietnam: your consent, as set out in your local privacy notice. Your name, email address, IP address, and device signals submitted at application stage. AI-generated fraud signals and supporting keywords derived from your application data.
AI-assisted application ranking. SharkNinja uses an AI tool to rank applications against role requirements to support consistent and efficient shortlisting. Rankings are reviewed by a member of the recruitment team before any shortlisting decision is made. This processing involves profiling; we evaluate aspects of your professional background and experience by automated means to assess your suitability for a role. If you are applying for a role based in New York City, Talent Matching is subject to the additional disclosures for Automated Employment Decision Tools set out under ‘New York City candidates’ notice. Legitimate interests in operating a consistent and efficient application screening process. Candidates in Illinois: your consent, which will be obtained before your application is ranked. Candidates in China and Vietnam: your consent, as set out in your local privacy notice. New York City candidates: see ‘New York City candidates’ notice. Your CV content, work history, qualifications, and skills as submitted in your application. AI-generated categorical ranking outputs and match reasoning derived from your application content.

We may also collect Personal Data about you indirectly online to the extent that you have chosen to make this information publicly available (e.g., LinkedIn). We may also collect data from professional recruiting firms, references, prior employers, and SharkNinja employees involved in your recruitment.

Sensitive Personal Data may be collected as permitted by law (e.g., U.S. equal opportunity laws) to support our diversity efforts or if voluntarily shared by you.

Artificial Intelligence (AI)

SharkNinja recognises the potential of artificial intelligence (AI) to transform the way we work and improve the products and services we provide. We are committed to ensuring we use AI in a secure and responsible way, respecting privacy, confidentiality and your data protection rights. This commitment includes any AI used by third parties on our behalf.

In the context of recruitment, SharkNinja uses AI-powered tools within its applicant tracking system to support three specific activities: interview recording and note generation (Notetaker); fraud signal detection at application stage (Real Talent); and application ranking (Talent Matching). Details of each activity, including the legal basis and categories of data processed, are set out in the processing table above.

All three AI tools are used to support human decision-making, not to replace it. No decision about your application is made solely on the basis of an AI output. Before any decision is made at interview, application screening, or shortlisting stage, a trained member of the SharkNinja recruitment team reviews the AI-generated output together with your full application, has the authority to disregard or override that output, and is not required or expected to adopt any AI-generated recommendation.

Real Talent and Talent Matching involve profiling within the meaning of applicable data protection law. This means we use automated processing to evaluate aspects of your professional background, experience, and application data to assess your suitability for a role. You have the right to object to profiling. Where you object, we will review your application without reliance on AI-generated outputs.

Your rights in respect of AI processing

In addition to the rights set out elsewhere in this notice, in respect of AI processing you have the right to:

  • Object to profiling carried out by Real Talent and Talent Matching.
  • Request that your application is reviewed without reliance on AI-generated outputs.
  • Request an explanation of any AI-generated output that has been taken into account in a decision about your application.
  • Request correction of inaccurate personal data held in your candidate record, including AI-generated outputs.

Candidates in Illinois have additional rights under the Illinois Artificial Intelligence Video Interview Act, including the right to consent before any AI analysis of your video interview takes place and the right to request destruction of your interview recording.

SharkNinja does not collect, capture, or store any biometric identifiers or biometric information, as defined under BIPA, in connection with Real Talent, Notetaker, or Talent Matching.

Talent Matching is audited for bias by an independent auditor at least once every 12 months. Talent Matching has not yet been used to evaluate candidates; because no historical usage data exists yet, the initial audit is based on test data rather than historical data, and the published summary will disclose the source of that test data and the reason historical data was unavailable. AI systems transparency

In accordance with applicable AI regulation, SharkNinja monitors the classification of the AI tools used in recruitment under evolving AI-specific laws, including the EU AI Act, and will implement the risk management, human oversight, documentation, and registration obligations that apply once those tools are confirmed as high-risk systems and those obligations take effect for SharkNinja as a deployer. None of the AI tools described in this notice are used to infer or evaluate your emotional state from your voice, facial expression, or other biometric signals. Human oversight is maintained throughout the recruitment process: a trained recruiter can always override an AI-generated output and is not required to rely on it. Colorado candidates and California candidates: additional AI-specific disclosure rights may apply to you under Colorado and California law beginning January 1, 2027; we will update this notice as those requirements take effect.

Cross-border Transfer and Use of Personal Data

Your Personal Data will be accessed by our recruitment team globally. Administrative and IT personnel may also have limited access where necessary. For transfers to countries without an adequacy decision, SharkNinja ensures protection via intra-company agreements including Standard Contractual Clauses and/or the UK International Data Transfer Addendum.

Sharing of your Personal Data with Third Parties

We use third-party service providers to support recruitment (e.g., identifying talent, pre-employment screening). We will not sell your Personal Data. Where shared, we take appropriate measures to ensure compliance with our security and privacy standards.

Security

SharkNinja maintains administrative, technical, organizational, and physical safeguards designed to protect against loss, misuse or unauthorized access, disclosure, alteration, or destruction of your personal information in accordance with applicable privacy and data security laws.

Deletion and Retention of Personal Data

If hired, relevant Personal Data collected during recruitment will form part of your personnel records. If not employed, SharkNinja may retain your data up to two years (dependent on country) for administration, future roles, and recruitment monitoring. Thereafter, only anonymised data will be retained for analytics.

AI-generated interview recordings, transcripts, notes, and scoring or ranking outputs are retained only for as long as necessary to support the recruitment decision and any legally required record-keeping period and are deleted sooner where you make a valid request for destruction (see ‘Your rights in respect of AI processing’ above).

  • Right to request information about the Personal Data we hold about you.
  • Right to request a copy of the Personal Data that we hold about you.
  • Right to amend or rectify your Personal Data if incorrect or outdated.
  • Right to portability of your Personal Data (where collected under consent or contract and processed by automated means).
  • Right to request erasure of your Personal Data.
  • Right to object to processing where based on legitimate interest.
  • Right to demand restriction of processing of your Personal Data.
  • Right to withdraw your consent (where processing is based on consent).
  • Right to provide instructions regarding processing of your Personal Data in case of death.
  • California residents: right under CCPA to request annually a list of third parties your Personal Data was disclosed to and what was shared.

SharkNinja does not sell or share Personal Data with third parties.
